Terms and Conditions

1. Scope

These General Terms and Conditions apply to all contracts for the temporary rental of hotel rooms for accommodation concluded between NIH Feldkirch GmbH & Co KG and third parties (guest), as well as to all other services and deliveries provided by NIGHT INN Hotel.

2. Reservations

By making a reservation, the guest offers to conclude an accommodation contract. Subject to availability of the booked room, the guest receives a reservation confirmation from NIGHT INN Hotel. Upon acceptance, an accommodation contract is concluded between NIGHT INN Hotel and the guest.

Offers of NIGHT INN Hotel regarding available rooms are subject to change and non-binding. NIGHT INN Hotel may refuse the conclusion of an accommodation contract at its sole discretion.

There is no entitlement to accommodation in a specific room. NIGHT INN Hotel reserves the right to define industry-standard restrictions such as minimum stays, booking guarantees or deposits for certain dates.

3. Cancellation Policy

A reservation is considered guaranteed if the guest confirms payment for the accommodation by providing a credit card number. A guaranteed reservation may be cancelled free of charge until 3:00 PM on the day before arrival, stating the reservation number. After 3:00 PM, cancellation is excluded and NIGHT INN Hotel retains the right to the agreed compensation minus any expenses saved. The same applies in case of no-show. For multi-day guaranteed reservations, all subsequent nights from the second night onwards will be cancelled; there is no entitlement to these nights.

4. Accommodation Prices and Other Prices

The prices displayed by NIGHT INN Hotel at the time of contract conclusion apply. The applicable prices are gross total prices and include all statutory taxes, fees and charges. Not included are local levies payable by the guest according to municipal law, such as tourist tax.

In the event of changes in tax, fee or levy rates or the introduction of new taxes, fees or charges previously unknown to the parties, NIGHT INN Hotel reserves the right to adjust prices accordingly. For contracts with consumers, this only applies if the period between booking confirmation and contract adjustment exceeds four months.

5. Payment Terms

The total price of the booked accommodation must be paid by the guest in advance upon arrival at the hotel. Set-off by the guest is excluded unless it concerns an undisputed or legally established claim. Accepted payment methods are cash in euros, debit card, MasterCard and VisaCard.

6. Use of Reserved Rooms

Reserved rooms are available to the guest from 3:00 PM on the day of arrival until 10:00 AM on the day of departure. Upon request and subject to availability, a late check-out may be agreed in advance. If approved, the hotel may charge EUR 10.00 per commenced hour. Departures after 3:00 PM will be charged the full daily room rate. There is no contractual entitlement to late check-out.

7. Resale

The resale, subletting and/or re-marketing of booked rooms is prohibited. In particular, forwarding rooms or room contingents to third parties at higher prices than the actual room rate is not permitted. Assignment or sale of claims against NIGHT INN Hotel is also not permitted. In such cases, NIGHT INN Hotel is entitled to cancel the booking. Use of the hotel room for purposes other than accommodation is expressly prohibited.

8. Liability of NIGHT INN Hotel

NIGHT INN Hotel is liable for damages resulting from injury to life, body or health caused by the hotel. Furthermore, NIGHT INN Hotel is liable for damages based on intentional or grossly negligent breach of duty as well as for breach of essential contractual obligations. Breaches by legal representatives or employees are deemed equivalent. Further claims for damages are excluded to the extent permitted by law.

In case of disruptions or defects in hotel services, the hotel will remedy them upon knowledge or immediate complaint by the guest. The guest is obliged to contribute reasonably to remedying the disruption and minimizing possible damage.

For items brought in, NIGHT INN Hotel is liable in accordance with statutory provisions. Claims expire if the guest does not report immediately. For cash, securities and valuables exceeding EUR 800 or other items exceeding EUR 3,500, a separate written agreement is required.

Provision of a parking space in the garage or parking area – even for a fee – does not constitute a safekeeping contract. No surveillance obligation exists.

9. Termination of the Accommodation Contract

NIGHT INN Hotel is entitled to terminate the accommodation contract for good cause, in particular force majeure, false information by the guest, endangerment of hotel operations or unlawful purpose of stay.

10. Vouchers

Vouchers purchased at NIGHT INN Hotel can only be redeemed for hotel services in the specified hotel. Remaining credit remains valid. Validity period is three years from date of issue. Vouchers are non-transferable and cannot be redeemed for cash. Redemption via online payment is not possible.

Right of withdrawal: Vouchers may be revoked within 14 days without stating reasons. Revocation must be addressed to NIH Feldkirch GmbH & Co KG, Bahnhofstraße 44, 6800 Feldkirch, or by email to feldkirch@night-inn.com.

11. Brought Food and Beverages

Consumption of brought food and beverages is prohibited in public areas. Breakfast may only be consumed in designated areas. Taking breakfast items away is not permitted. Preparation of food in the rooms is prohibited.

12. Non-Smoking Hotel

NIGHT INN Hotels in Austria are non-smoking hotels. Smoking is prohibited in all public areas and guest rooms. In case of violation, a flat compensation fee of EUR 250.00 may be charged. Higher or lower damages may be proven.

13. Pets

Bringing pets requires prior approval of NIGHT INN Hotel. A fee of EUR 10.00 per night applies. Guide and service dogs are exempt.

14. Special Payment and Cancellation Conditions

Separate payment and cancellation conditions apply for group bookings of more than ten rooms or allotment contracts.

17. Final Provisions

Amendments and additions must be made in text form. Austrian law applies.
